ON MARCH 15, 2016 WE WROTE AN ARTICLE ENTITLED “‘YA GOT TROUBLE'” IN THE INDIAN RIVER SOUTH BEACH PROPERTY ASSOCIATION, INC.” (SBPOA) ABOUT HOW ASSOCIATION PRESIDENT GEORGE D. F. LAMBORN HAD TAKEN “THE UNPRECEDENTED MEASURE OF FILING SUIT IN THE CIRCUIT COURT OF INDIAN RIVER COUNTY TO PREVENT THE ILLEGAL TAKEOVER OF THE SBPOA BY A GROUP OF DISSIDENT DIRECTORS, WHO ARE (WERE) ACTING AT THE BEHEST AND WITH THE ACTIVE COLLABORATION OF A PUBLIC OFFICIAL.”

The lawsuit, filed on March 11, 2016, named Steve Merselis, David De Wahl, Victor Cooper, Robert Dewaters, John J. Burns, Frank Spitzmiller, George Bryant, Thomas Brown and the SBPOA as defendants. Mr. Lamborn was the lone plaintiff.

Then on March 31, 2016 we wrote about the “The Presumed Collapse of the SBPOA,” where three dissident directors of SBPOA, claiming to represent “80%” of the constituency of the Association threaten to withdraw their Associations unless they are in control.

To this article we had some interesting comments on our Vero Communique Facebook page:

“Hostile takeover, follow the money.”

“Tell them they are unnecessary and you are very happy they are breathing.”

“HHO’s and PHO’s are just a bunch of people that they think they know what they’re doin.  Usually they don’t have a clue.”

“I dont know if i like this or not sounds like an air bag blowing air up someones skirt … or trying to ?”

Now, in a release dated April 1, 2016, SBPOA president Mr. Lamborn wrote that Directors Thomas Browne, representing Windward Condominium Association of Vero Beach, Inc., George Bryant, representing the Moorings of Vero Beach Property Owners Association, Inc., John J. Burns, representing the Sandpointe Property Owner’s., and Frank M. Spitzmiller, representing the Seagrove Property Owners Association “have each submitted a letter of resignation from the Board of Directors of the South Beach Property Owners Association, Inc. (SBPOA) effective this day.”

Further, Mr. Lamborn wrote that these four Associations “remain members in good standing…and as such, are entitled and very much encouraged, to submit to the SBPOA Nominations and Elections Committee the names of their respective members  for Nominations and Elections for filling the vacancies so created.

For some time, it has been my desire to have a Board of Directors that is younger, more energetic, and much more representative of the of the diverse community we represent – the whole South Beach, and not just a few of its larger gated communities.

SBPOA believes that the vacancies created by these resignations afford an excellent opportunity to fulfill the goal of making the SBPOA a more vigorous and effective voice for the welfare and quality-of-life of South Beach property owners and residents.”
